Bad Weather Driving

As the Holiday season approaches, so do does the inclement winter weather.  Like many parts of the country, Westchester County, Yonkers, and Rye will soon be receiving its fair share of snow and sleet for the season.

When the weather turns bad, it is important to remember that New York law requires drivers who have their windshield wipers on to turn on their head lamps as well.  Failure to do so can result in an officer issuing the offending driver with a summons and a date in court.

While the purpose of the law is to protect the public, there are may be other unintended adverse consequences for an unsuspecting motorist.  When an officer stops your vehicle to issue you a summons, you are opening yourself up to a search of your vehicle.  The officer can take a survey of any item in plain view of your vehicle.  If the officer sees any contraband or has reasonable cause to believe that you have been drinking and driving, you may be facing criminal prosecution.  Thereafter, you may need to retain the services of a criminal defense attorney.  The lesson here is that you should always obey the law.  A simple traffic stop could be more costly and you could be facing additional charges. Sometimes an ounce of prevention is worth its weight in gold.
