When a driver receives a speeding ticket, cell phone
violation, or traffic ticket, it is important that they enter a plea of either
guilty or not guilty. Failure to
do so could result a driver’s privilege to drive to be suspended. When a person
drives with a suspended license, they are committing a criminal act for which
they can be arrested.
The instructions for entering a plea are easy to follow and
they are listed on the ticket. As
such, it is highly recommended that every driver read the front and back of
their ticket thoroughly to ensure they follow the proper protocols.
After reading the ticket, if the driver continues to have
questions, it is advisable that they call the court or visit the court for
further guidance.
WHERE IS THE COURT
Philipstown Town Court is located in Putnam County. The street address is

JURISDICTION
As a Town Court, Philipstown has limited jurisdiction over
legal matters. It can adjudicate some
criminal cases, civil cases, and traffic cases. Civil cases heard in
Philipstown Court are usually referred to as small claims cases. The dollar amount in controversy is
usually under $3,000.00. With
respect to criminal cases, the majority of crimes can be classified as
misdemeanors. The traffic calendar
can include every violation under the vehicle traffic law excluding misdemeanors and felonies.
PART TIME COURT
Philipstown is a part time court. It employs two judges who alternate turns presiding over
court calendars. Although it is a
part time court, it meets more than once a week. It maintains a traffic calendar on Mondays and
Wednesdays. It can add additional
court dates as necessary.
PROSECUTION
The local prosecutor instead of the District Attorney’s
Office prosecutes traffic tickets that are written within the jurisdictional
grounds of this court. The
District Attorney maintains jurisdiction over criminal cases. Meanwhile the
special prosecutors handle traffic offense.
COURT DATE
If a driver properly enters a not guilty plea, they will
receive a letter in the mail advise them of their court date. If a letter is not received, the onus
is upon the driver to proactively call the court to ascertain when they should
attend court.
APPEARING IN COURT
When a driver appears in court, they will have the
opportunity to conference their case with the prosecutor. If an amicable resolution cannot be
reached, their matter will be adjourned for trial. At trial, the driver will have the opportunity to present
evidence and confront the prosecutions witnesses. Conducting a trial can be a difficult task for experienced
