BACKGROUND

I-87 is a major highway that cuts across many different counties in New York State.  It stretches for hundreds of miles and has claimed many victims to a hefty speeding ticket.  As it passes through Rockland County, one of it is favorite places to catch unsuspecting drivers is in the municipality of Clarkstown.  Tickets issued in jurisdictional boundaries of Clarkstown Town Court are heard before local court judges and prosecuted by local prosecutors.  For speeding tickets issued by the State Police, cases are prosecuted by the Town Prosecutor’s Office.  Tickets issued by the Town Police are prosecuted by the Town Police Officers that issued the summons.

The court employs several part time judges.  Each judge is in charge of upholding the Constitution of the United States.  They work on a rotating basis presiding over court calendars.

TRAFFIC COURT

Under the Vehicle Traffic Law, drivers charged with a moving violation are afforded an opportunity to appear in court without proceeding immediately to trial.  This initial court appearance will give litigants an opportunity to resolve their traffic tickets without a cumbersome trial.

ARRIVING TO COURT

Whenever a person enters Clarkstown Court, they are subject to a search.  The courtrooms are located on the 2nd floor and when a person exits the elevator, they will be directed to pass through a magnetometer.  They will be advised to empty their pockets and open all bags.  If any inappropriate items or contraband is found, the court officers can take appropriate legal action.

CHECKING IN

When you walk into the courtroom, you will be directed to the court attendant who will mark your attendance.  Your failure to check in may cause a delay in having your case called.
THE JUDGE

When the Judge calls your case, you should stand up and acknowledge your presence and approach the podium if directed. 

COURT DECORUM

It is important to be respectful to the court during all stages of the proceedings.  Even if you are merely observing the proceedings, you must remain silent, avoid eating candy, and refrain from using all electronic devices.
